I have been reading the blogs about HIV but they do not address my specific situation as I am applying for an immigrant visa.

Latest NewsThe change in regulation applies to both nonimmigrant and immigrant visa applicants.  If you have applied for an immigrant or fiancee visa and your application is currently being processed by the Embassy, please contact the Operator Assisted Information Service for further information.   You should also contact the Operator Assisted Information Service if you are currently being processed for a waiver of ineligibility.  

If you have not yet completed the visa application form DS-230 Part One and you will be submitting it to the Embassy on or after January 4, 2010, you will no longer be required to answer “Yes’ to the question “Have you ever been afflicted with a communicable disease of public health significance of a dangerous physical or mental disorder, or ever been a drug user or addict” based solely on your HIV status.
