I have just seen your blog about the Amcit whose son was refused an immigrant visa because he does not live in the United States. I am filing an immigrant visa petition for my husband. I live in the United Kingdom. Does that mean that my husband will not qualify for an immigrant visa?
In order to file an Affidavit of Support, Form I-864, the sponsor must be a resident of the United States. However, if you reside in the United Kingdom you will not automatically be disqualified from being a sponsor if you can show that you are in the United Kingdom temporarily, or if you have not maintained a residence in the United States, that you intend to re-establish residence there.

I am an American Citizen and my son has just been refused an immigrant visa as I do not intend returning to the United States to live. Why wasn’t I told this when I filed the petition?
